The Schengen agreements and other normative instruments adopted by the European Union (EU) to ensure freedom of movement in the territory of the Member States, are closely linked to the other side of this process: the control of external borders. In the past ten years, various mechanisms have been created to prevent, control and sanction illegal immigration towards the European Community. The rules relating to the visa, the liability of carriers and joint operations of return of immigrants (EU. European Council Regulation No. 574/1999; Directive n. 51/2001 and Decision 573/2004a), or systems of information and surveillance at borders (Schengen Information System – SIS, and the European Agency for the management of operational cooperation at the external borders – FRONTEX1), are some of those devices.
