The progressive abolition of internal borders in Europe to the beat of the process of European integration has been giving rise to the need to set up a space of freedom, security and justice that gives meaning to a new community concept of external border of the EU. Security is the central idea of this new concept which is projected with special intensity in the southern maritime borders of the Union, stage of the humanitarian tragedy involving smuggling of immigrants. The elements of a humanitarian, historical, nature of extension and geographical proximity, social inequality, economic imbalance, increasing demographic pressure, high costs and media impact, place us before a problematic reality that constitutes an extraordinary challenge for the EU.
